1. Important notice about using the "SHINTRONIC"

Make sure that you understand how to wear and how to use the Shintronic. Never tighten your boots extremely tight around the Shintronic as perspiration has to find a way out. We advice not to use the Shintronic in foamed boots as to much heat will build up. We advice not to use the Shintronic when your boots appear to tight or to small to wear the Shintronic. We advice not to use the Shintronic when your skin is allergic to neoprene. Stop using the Shintronic in all cases that a severe blister or severe pain is coming up. The Shintronic does not claim to prevent all pain problems of all users.

In some cases, replacing the padding inside the Shintronic might help you to find a better adjustment. Take your time and have some thoughts about it.

Pressure and moisture can be a bad combination. You get the best ventilation and good performance results of the Shintronic when you use the Shintronic in a rather loose way while skiing or boarding (not too loose). We do not bear any kind of responsibility related to your snow sport capacities or related to the risks you undertake when practicing snow sports. The Shintronic is not a device to avoid bone fractures or to avoid other injuries. You as an individual will always be responsible for the risks you undertake when using the Shintronic device.

2. Warranty coverage

All Airproteck BV products, carry a one-year Limited Warranty against defects in materials and workmanship. Airproteck BV’s warranty obligations are limited to the terms set forth below: Airproteck BV warrants its products against defects in materials and workmanship under normal use for a period of one (1) year from the date of retail purchase by the original end-user purchaser ("warranty Period"). If a defect arises and a valid claim is received within the Warranty Period, at its option, Airproteck BV will either (a) exchange the product with a product that is new, or (b) refund the purchase price of the product. When a refund is given, the product for which the refund is provided must be returned to Airproteck BV and becomes Airproteck BV's property.

This warranty does not apply: (a) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (b) to damage caused by operating the product outside the permitted or intended uses described by Airproteck BV; (c) to a product or part that has been modified to significantly alter functionality or capability without the written permission of Airproteck BV. Except as provided in this warranty and to the extent permitted by law, Airproteck BV is not responsible for direct, indirect, punitive, special, incidental or consequential damages whether resulting from the use, misuse or inability to use the product or from defects in the product, or under any other legal theory including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of damage or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Third-party products are sold "AS IS" by Airproteck BV, but may be accompanied by their manufacturers' standard warranties. "AS IS" products are sold by Airproteck BV as is, where is, and with all faults, and without express or implied warranties from Airproteck BV. If you have questions about any manufacturers' warranties that accompany such products, please contact the manufacturer directly.

No Airproteck BV reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.

3. Access to the websites

We go to great efforts to ensure that availability of the websites will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the websites may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

4. Licence for website access

Our websites grants you a limited license to access and make personal use of the websites, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Airproteck BV. The websites or any portion of the websites may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Airproteck BV and its affiliates without express written consent. You may not use any meta-tags or any other "hidden text" utilizing Airproteck BV’s or its affiliates' names or trademarks without the express written consent of Airproteck BV. Any unauthorized use terminates the permission or license granted by Airproteck BV.

5. Your conduct

You must not use the websites in any way that causes, or is likely to cause, the websites or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not Airproteck BV, are responsible for all electronic communications and content sent from your computer to us and you must use the websites for lawful purposes only.

6. Children

If you are under 18, you may use the websites only with the involvement of a parent or guardian.

7. Copyright and database rights

All content included on the websites, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Airproteck BV, its affiliates or its content suppliers and is protected by Dutch and international copyright and database right laws. The compilation of content on the websites is the exclusive property of Airproteck BV and its affiliates and is protected by Dutch and international copyright and database right laws. All software used on the websites is the property of Airproteck BV, our affiliates or our software suppliers and is protected by Dutch and international copyright laws.

8. Trademarks

‘Manoove’ and other marks indicated on our websites are trademarks or registered trademarks in the European Union and/or other jurisdictions. Airproteck BV’s graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of Airproteck BV. Airproteck BV’s trademarks and trade dress may not be used in connection with any product or service that is not Airproteck BV’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Airproteck BV. All other trademarks not owned by Airproteck BV that appear on the websites are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Airproteck BV.

9. Patents

More patents apply to the websites and to the products and services accessible via the websites, including without limitation: NL Patent 1029572 / PCT/NL03/006265 and all corresponding foreign counterparts. These patents are protected by Dutch and by international law. Infringement is an illegal act and will be reacted upon in a legal way.

10. Alteration to the Conditions

We reserve the right to make changes to our websites, policies, and these general terms & conditions of use at any time. You will be subject to the policies and the general terms & conditions in force at the time that you use the website or that you order goods from us. If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

11. Airproteck BV’s unsolicited idea submission policy

Airproteck BV or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new or improved products or technologies, product enhancements, processes, materials, marketing plans or new product names. Please do not send any original creative artwork, suggestions or other works. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Airproteck BV products or marketing strategies might seem similar to ideas submitted to Airproteck BV. So, please do not send your unsolicited ideas to Airproteck BV or anyone at Airproteck BV. If, despite our request that you not send us your ideas, you still send them, then regardless of what your letter says, the following terms shall apply to your idea submission. You agree that: (1) your ideas will automatically become the property of Airproteck BV, without compensation to you, and (2) Airproteck BV can use the ideas for any purpose and in any way, even give them to others.

12. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

13. Governing law and jurisdiction

Use of the websites and interpretations and applications of the general terms & conditions of use shall be governed in accordance with the laws of The Netherlands. Additionally, unless otherwise specified, the Dutch Court has exclusive first instance jurisdiction for all disputes arising regarding the websites and the terms.
